Talc Fight Drives Ben Nye to File Chapter 11 Bankruptcy

Beauty Independent reported that Hollywood makeup artistry brand Ben Nye filed for Chapter 11 bankruptcy in the Central District of California in an attempt to save the business amidst a flurry of talc lawsuits.WHO: Founded in 1967 by legendary Hollywood makeup artist Ben Nye, Sr., the namesake brand was created using his extensive knowledge to create quality color cosmetics for professionals. The Ben Nye brand develops products for every genre of makeup, including performance, beauty, and special effects. The brand remains family run, with most products still produced by the company in its Los Angeles facility. Ben Nye relies on a global network of about 500 wholesale partners to sell its 1,600 stockkeeping units priced between $8 to $78.WHY: Chapter 11 bankruptcy will allow the brand to put a hold on the pending suits so that it can reorganize, with the goal to end the financial burden of disputing the talc lawsuits that have engulfed the beauty and personal care industries. IN THEIR OWN WORDS: In an Instagram post, the brand said, "We would like to confirm reporting that our company is in the process of a Chapter 11 reorganization as supervised by the bankruptcy court in Los Angeles, California. Our day-to-day operations have not changed and our full team of employees continue to manufacture products with the same high quality we have always had.⁠"Ben Nye President Dana Nye wrote in an email to Beauty Independent, “The company has incurred monumental legal fees to defend itself.
